ABSTRACT

Introduction. Currently, intellectual property appears to be a necessary condition for the competitive advantages of modern organizations, and therefore there is a need to intensify the innovation process and policies aimed at changing and using intellectual property. The active development of digital technologies and the increasing complexity of the economy entail support for approaches to the legal regulation of individual legal institutions, which, of course, include intellectual rights. The importance of intellectual assets as a factor of competitiveness in an innovative economy determines the need for a scientific approach to the management and legal protection of intellectual property, which determined the choice of research topic. The constant process of digitalization of various spheres of human activity and the increased use of artificial intelligence necessitate continued research into this issue. Methods: systemic, historical, comparative legal, general scientific, statistical, logical, complex. Results: The creation, protection, evaluation and use of intellectual property objects are often further scientific or industrial activities, and therefore there is a need to pay attention to the legal aspects of the use of the results of creative activity. It can be stated that ensuring the security of the results of intellectual activity largely depends on an understanding of the essence of intellectual property, on methods of ownership and methods of its protection in accordance with the legal norms enshrined in legislation. In order to improve the process of managing the results of intellectual activity, it is necessary to develop a strategy that includes not only a mechanism for creating an innovative product, but also a procedure for ensuring its legal protection, taking into account the exclusive rights to it and the subsequent involvement of intellectual property objects in a single circulation.
