ABSTRACT

The complex comparative analysis of the adjacent institutes improving a legal status of the convicts to imprisonment enshrined in the existing criminal and executive legislation is carried out. The position about independence of each of the considered institutes is proved. As one of the penal institutes accommodation of convicts outside correctional facilities acts. In modern conditions accommodation of convicts outside colony is applicable in correctional facilities of a general regime concerning men and women, in educational colonies and also in colonies settlements when performing the conditions specified by the legislator. Categories of convicts who may be accommodated out of colony, the basis of granting the present possibility to them and various practice developed by correctional facilities in the studied question are considered.
